Cognizable And Non Cognizable Offences Law Essay Cognizable offences have been defined under Section 2 (c) of the Criminal Procedure Code as follows; cognizable offence means an offence for which, and cognizable case means a case in which, a police officer may, in accordance with the First Schedule or under any other law for the time being in force, arrest without warrant. A non-cognizable offence has been defined under Section 2 (l) of the Criminal Procedure Code as follows, non-cognizable offence means an offence for which, and non-cognizable case means a case in which, a police officer has no authority to arrest without warrant. Now which offence falls under the category of cognizable offences and which falls under the category of non-cognizable offences can be determined as per the classification given in the First Schedule of the Criminal Procedure Code. The First Schedule has classified all acts punishable under the Indian Penal Code, 1860 into Cognizable and non-cognizable offences. Although the Code in itself does not give any reasoning as to this classification, certain patterns can be traced if the First schedule is studied carefully. All offences which have a punishment of more than 3 years under the Indian Penal Code are considered to be cognizable offences and all offences which have a punishment of less than 3 years are non-cognizable offences. Subsequently, it can be deduced that non-cognizable offences are relatively less serious in nature than cognizable offences. Consequently, in case of cognizable offences, the police officers can arrest the accused person without any warrant or authority issued by a magistrate. They can initiate investigation on their own accord and they neednt wait for the prior permission of a magistrate. In fact, they have a legal duty to initiate investigations. This duty has been endowed upon them by Section 156(1) of the Criminal Procedure code which reads; Any officer in charge of a police station may, without the order of a Magistrate, investigate any cognizable case which a Court having jurisdiction over the local area within the limits of such station would have power to inquire into or try under the provisions of Chapter XIII. Section 156 (2) further reads, No proceeding of a police officer in any such case shall at any stage be called in question on the ground that the case was one which such officer was not empowered under this section to investigate. On the other hand, police officers necessarily need prior permission of a magistrate to initiate investigations in cases of non-cognizable offences. Non cognizable offences are considered more in the nature of private wrongs and therefore the collection of evidence and the prosecution of offender are left to the initiative and efforts of private citizens. Bailable and Non-bailable offences Section 2 (a) of the Criminal Procedure Code defines bailable and non-bailable offences as an offence which is shown as bailable in the First Schedule, or which is made bailable by any other law for the time being in force; and non-bailable offence means any other offence In here too, the code does not give any reason as to on what criteria has such classification been based upon. It just lays down a seemingly arbitrary classification of the same. However, it can be logically deduced that all serious offences are non-bailable whereas all less serious offences are bailable. Similarly, all offences which have a punishment of more than 3 years under the Indian Penal Code are considered to be non-bailable offences and all offences which have a punishment of less than 3 years are bailable offences. This too is subject to the exception of existence of a contrary law. If a person accused of a bailable offence is arrested or detained without warrant he has a right to be released on bail. In case he is accused of a non-bailable offence, then his bail is subject to the discretion by the authorities. Warrant case and Summons Case According to Section 2 (x) of the Criminal Procedure Code, a warrant-case means a case relating to an offence punishable with death, imprisonment for life or imprisonment for a term exceeding two years. According to Section 2 (w) of the Criminal Procedure Code, a summons case means a case relating to an offence, not being a warrant case. This classification helps to determine the type of trial procedure to be adopted in the case. Naturally, the trial procedure in case of a warrant case is much more elaborate than that of a summons case. This classification is also useful at the stage of issuing process to the accused person in the first instance. CHAPTER II NEED FOR RECLASSIFICATION OF OFFENCES The current classification of offences has been a major cause for the high incidence of arbitrary and unnecessary arrest in our country. The scheme of classification is outdated and redundant. There is a serious need for revaluation for the classification between cognizable and non-cognizable and bailable and non-bailable offences. The nature and quantum of punishment attached to these offences also needs to be revaluated. It is not that the idea for reclassification has never come up before, but given the present situation of our judicial system, it becomes all the more relevant that it be done now. For instance, many minor offences against property are still classified as non-bailable, whereas it is evident that classifying them as compoundable offences and relying on methods such as plea-bargaining may be more effective and agreeable to address the injury caused by the same  [1]  . Also, it has been noted that the major portion of the backlog cases in the courts consists of regulatory offences such as dishonour of cheques, traffic violations, etc. Now, these acts were made offences under special laws whereby the legislature had felt that in lieu of public policy, these acts were better off classified as criminal even though they are more akin to civil wrongs. However, the fact that they will create a maximum backlog was envisaged by neither party. Hence, there is a need for an informed study and revaluation of criminal laws. It has been suggested that the offences be classified into a) The Social Welfare Code, b) The Correctional Code, c) The Criminal code and d) the Economic and other offences code. This approach of classifying the offences as per their nature is considered to be far more useful than a blanket categorization of offences. This re-classification is proposed to be done on the basis of the gravity of the offences, appropriate procedures for investigation and dispute-resolution as well as the proportionate nature and quantum of fines and punishments. CHAPTER III RECOMMENDATIONS OF THE MALIMATH COMMITTEE Considering the need for reclassification of offences, the Malimath committee gave the following recommendations for the same. Its primary recommendation was to remove the distinction between cognizable and non-cognizable offences and make it obligatory on the Police to investigate all offences in respect of which a complaint is made. However, this is not a very practical option as it will lead to a further backlog of cases and will increase the burden on the police. Section 262 of the Criminal Procedure Code provides for the procedure for summary trials, Section 263 provides for the record in summary trials and Section 264 provides for judgement in cases tried summarily. The Malimath committee recommended increasing the number of cases falling within the category of cases trialable by following the summary procedure presented by Sections 262 to 264. It also recommended increasing the number of offences that fall under the category of Petty Offences which can be dealt with by following the procedure prescribed by Section 206 of the Code. Section 206 reads If, in the opinion of a Magistrate taking cognizance of a petty offence, the case may be summarily disposed of under section 260, the Magistrate shall, except where he is, for reasons to be recorded in writing of a contrary opinion, issue summons to the accused requiring him either to appear in person or by pleader before the Magistrate on a specified date, or if he desires to plead guilty to the charge without appearing before the Magistrate, to transmit before the specified date, by post or by messenger to the Magistrate, the said plea in writing and the amount of fine specified in the summons or if he desires to appear by pleader and to plead guilty to the charge through such pleader, to authorise, in writing, the pleader to plead guilty to the charge on his behalf and to pay the fine through such pleader: Provided that the amount of the fine specified in such summons shall not exceed one hundred rupees. (2)   For the purposes of this section, petty offence means any offence punishable only with fine not exceeding one thousand rupees, but does not include any offence so punishable under the Motor Vehicles Act, 1939, (4 of 1939) or under any other law which provides for convicting the accused person in his absence on a plea of guilty. It advocated increasing the number of offences, for which an arrest neednt be made and increasing the number of offences where arrest can be made only with the order of the court and reducing the number of cases where arrest can be made without an order or warrant form the Magistrate. The Malimath committee further recommended increasing the number of offences which are bailable and reducing the number of offences which are not bailable. A compoundable offence is one in which the trial court can compound the offence and dispose the case without trial. A non-compoundable offence is an offence in which the court cannot compound the case without trial. A compoundable offence is always a lesser degree offence punishable with a shorter jail term or fine. M ost grown men view women only as housewives, incapable of nothing else. In the minds of some men women were meant to stay at home and clean the house, raise the children, and cook the meals. Even when woman decided to join the work force they had few careers to choose from. It was not until the late 1980’s that woman were accepted in to higher paying careers by the men that were already dominating the workforce. Even today when they are accepted into the workforce they are still not paid as much as men for doing the same work. A 1998 study shows that a woman in the same job as a man with the same expectations and responsibilities, the woman is paid ten to fifteen percent less then the man. The media or television programs are also to blame for the image that is given to woman. Women play passive roles, in movies and even TV sitcoms. For example in the sitcom Dharma and Greg, which is about a young married couple, the man is a successful lawyer from a wealthy family, while Dha rma is a cute little unemployed blonde that cracks jokes. EXPERIMENT NO. 15 PROTEIN CHARACTERIZATION BY ELECTROPHORESIS Abstract The molecular weights of protein extracts were assessed by sodium dodecyl sulfate-polyacrylamide gel electrophoresis (SDS-PAGE). Two sets of four protein samples, standard bovine serum albumin (BSA), invertase, egg albumin, and casein, were prepared; one set containing ? -mercaptoethanol (BME) while the other did not. These were then analyzed through SDS-PAGE with 12. 5% resolving gel, prepared using 2 M Tris-HCl at pH 8. 8 and stacking gel, prepared using 0. 0625 M Tris-HCl at pH 6. . Results showed multiple bands located on the upper half of the gel, which suggested heterogeneity of the mixture and that the samples were heavy molecules. The action of these two denaturating agents cause the production of polypeptide chains of constant charge-to-mass ratios and uniform shapes due to the SDS molecules binding with the hydrophobic regions of the denatured polypeptide and masking the native charge of the protein by its negative charge. This restriction, coupled with the fact that mobility of the SDS-protein complexes are based on molecular size, forms the basis of the electrophoretic determination of purity and molecular weight (Boyer, 1993). This experiment will utilize SDS-PAGE to assess the molecular weights of the extracted proteins invertase, albumin, and casein, along with standard bovine serum albumin. The effect of the presence of ? -mercaptoethanol was also investigated. Methodology With the glass plates clean, the gel apparatus was first set up with the comb inserted between the glass plates. It was made sure of that the set-up would not leak by allowing a little amount of distilled water to enter it, which was discarded afterwards. A mark, one centimeter below the teeth of the comb, was placed on the glass plate. The resolving gel, at 12. 5% gel, was then prepared in an Erlenmeyer flask. Using a micropipette, 1450 ? L of 40% stock acrylamide, 775 ? L of 2% stock bisacrylamide, 875 ? L of 2 M Tris-HCl at pH 8. 8, and 1500 ? L of distilled water were measured and mixed in the Erlenmeyer flask. Afterwards, 47 ? L of 10% sodium dodecyl sulfate (SDS) and 40 ? L of freshly prepared 10% ammonium persulfate (APS) were added to the mixture. Then, ten microliters (10 ? L) of tetramethylethylenediamine (TEMED) was added and, after mixing it by swirling not more than three times, the mixture was poured into the gel apparatus with the aid of a micropipette up to the mark. The gel was then overlaid with a small amount of isobutanol-water mixture before it would start to harden. After the gel has completely polymerized, the isobutanol mixture was removed from the apparatus. Two pairs of two resolving gels were prepared as one pair would be used for samples containing ? mercaptoethanol and another pair for those that do not contain the said chemical. The stacking gel was prepared by taking 265 ? L of 40% stock acrylamide, 140 ? L of 2% stock bisacrylamide, 350 ? L of 0. 625 M Tris-HCl at pH 6. 8, and 940 ? L of distilled water and mixing all four in an Erlenmeyer flask. Afterwards, 25 ? L of 10% SDS and 60 ? L of 10% APS were added to the one in the flask. Immediately before the solution was added, 5 ? L of TEMED was added to it and swirled not more than three times, similar to that done with the resolving gel. This mixture was then rapidly transferred by a micropipette over the resolving gel and, after placing the comb over it, left to harden. The samples were prepared by getting 100 ? L of the protein sample, 20 ? L of distilled water, and 80 ? L of loading buffer with ? -mercaptoethanol in plastic tubes for the electrophoresis of the samples containing ? -mercaptoethanol. For those samples not containing the latter reagent, 80 ? L of the loading buffer was added. The same procedure was done for 100 ? L of bovine serum albumin. These were then placed in a boiling water bath for 10 minutes after which these were immediately immersed in an ice water bath for 3 minutes. The protein samples used were invertase, albumin, and casein. The loading buffer was prepared by mixing 2. 5 mL of 10% SDS, 2. 5 mL of 0. 625 M Tris-HCl at pH 6. 8, 2. 5 mL of 10% glycerol, and 5. 0 g of 0. 02% bromophenol blue, and diluting to 25 mL with distilled deionized water. Eight tubes were done all-in-all. The gel slabs were then placed in the gel chamber. The gel chambers were then filled with gel running buffer, making sure that the gel was completely immersed. This buffer was prepared by mixing 3. 0 g Tris base, 14. 4 g glycine and 1. 0 g SDS, and diluting to 1 L with distilled deionized water.. The set-up was then placed on a level surface. At this point, the comb was removed in one fluid motion to ensure that the wells would have straight edges. Ten microliters (10 ? L) of the samples with ? -mercaptoethanol was loaded into the wells using a micropipette. With the voltage set at 100 V and the protective electrode covering placed over the set-up, the gel was run until the dye reaches a level of 1 cm above the bottom of the gel slab. This was done again for those samples without the ? -mercaptoethanol. After the gels have been run, the gel slabs were transferred from the glass plates to a flat-bottom container where a small amount of staining solution was added until the slabs were completely immersed. This solution was prepared by mixing 50 mL of methanol, 10 mL of glacial acetic acid, and 0. 25 mg of Coomassie Brilliant Blue R250, and diluting to 100 mL with distilled deionized water. After that, the background staining was removed by several washings of destaining solution. This solution was prepared by mixing 25 mL of 95% ethanol and 5 mL of glacial acetic acid, and diluting to 100 mL with distilled deionized water. Results and Discussion Polyacrylamide Gel Electrophoresis (PAGE) served as an effective tool in the characterization of protein standards and extracts because of the gel’s high resolving power for molecules up to 106 Da, accommodation of larger sized samples, an inert enough matrix with respect to the migrating entities, and physical stability of the matrix (Boyer, 1993). Polyacrylamide gels were prepared by the catalyzed and cross-linked polymerization of the acrylamide-bisacrylamide mixture. The polymerization reaction was facilitated by ammonium persulfate (APS), the polymerizing agent, due to its inherent instability and, hence, its tendency to decay and to give rise to molecules initiating these polymerization. Tetramethylethylenediamine (TEMED) was introduced to catalyze the decay of APS. Figure 1 presents the general equation for the polymerization reaction of the acrylamide-bisacrylamide mixture (Encor Biotechnology, Inc. , 2011). Figure 1. Cross links were generated through the incorporation of bisacrylamide into the linear polyacrylamides. Since molecular oxygen would react with the free radical sulfate ions (SO42-) thereby inhibiting polymerization, degassing was necessary. Furthermore, the tendency of molecular oxygen to react with SO42- would also be the reason why it would be necessary for PAGE gels to be poured into tubes or between glass plates instead of horizontal apparatuses. However, the degassing step was not done due to the unavailability of a degassing chamber. Isobutanol was added on top of the gel to also prevent the entry and accumulation of O2 (Encor Biotechnology, Inc. , 2011). Gel pore size is inversely proportional to the concentration of acrylamide. Therefore, to generate a broad and efficient range of protein separation, a discontinuous gel system was formulated, having a low acrylamide content on top and a high acrylamide content at the bottom. The capability of Tris-HCl to facilitate the propagation of electric current through the matrix qualified it as an appropriate loading buffer. It allowed the proteins to be drawn by the current through the sieving matrix slab (Thermo Scientific, Inc. , 2011). The polyacrylamide gel electrophoreses set-up had three important features. First, a stacking gel was cast over a resolving gel. Second, the two gel layers had different ionic strengths and pH. Third, the stacking gel had a lower acrylamide concentration and a lower pH. These conditions allowed the protein molecules to first concentrate into a tight band before entering the resolving solution. In this experiment in particular, the charge of the protein was kept uniform all throughout using sodium dodecyl sulfate (SDS), a powerful detergent that would denature the protein and would leave it evenly negatively charged. Also, ? -mercaptoethanol was added to cleave the disulfide bonds, enforcing completely disrupted secondary, tertiary, and quarternary structures. Prior to the loading of the sample, the discontinuous gel system was immersed in a glycine-Tris buffer prepared at pH 8. 8. At this pH, the two form of glycine – its Zwitterion ion and glycinate – would exist in equilibrium. H3N+CH2COO- – H2NCH2COO- + H+(2) When the voltage was turned on, the entry of buffer ions (glycinate and H+) to the stacking gel (pH 6. 8) shifted the equilibrium to the left, increasing the concentration of glycine’s Zwitterion ion, which would have a zero net charge, and therefore, would be electrophoretically immobile. Since the protein molecules would still be anionic at pH 6. , they would replace the nonmobile glycine molecules in order to keep the current running. As such, the relative mobilities of the ions in the stacking gel would be Tris base > protein sample > glycinate. Furthermore, the thin band observed in the upper gel would actually pertain to the protein molecules sandwiched between the Tris-base and the glycinate ions . The resolving gel, on the other hand, had a pH of 8. 8. When the ionic front reached it, the equilibrium of glycine species shifted to the right. The increase in pH and decrease in pore size retarded the movement of proteins and rendered the glycinate ions greater mobility. The relative rates of movement then became Tris-base > glycinate ions > protein samples. From there, it was the mass of the protein molecules that governed their mobility and thus identified them (Boyer, 1993). For qualitative analysis of results, the Coomassie brilliant blue dye (R-250), being the most popular staining reagent for the electrophoresis of protein samples, was used. Its mechanism of binding to the basic and hydrophobic groups of proteins manifested in the dull, reddish-brown to intense blue color change of the solutions. The staining method was started with the water wash of the gel cast to remove the electrophoresis buffers from the matrix. The matrix was then washed with methanol followed by glacial acetic acid to prevent the diffusion of protein bands form the matrix. The treatment with the dye followed. Lastly, destaining measures were employed to get rid of excess dye from the background gel matrix. This would allow a clear visualization of the bands that had formed (Thermo Scientific, Inc. , 2011). Figures 2 and 3 are photographs of the two gels after incubation and subjection to the dye. These could come in the form of other proteins, contaminants, or other impurities. Nonetheless, any of these possibilities suggest one thing; the sample is not pure although there are occasional times when homogeneous samples result to multiple bands due to degradation during the electrophoresis procedure (Boyer, 1993). Also, the identity of the proteins could have been determined if there were standards or â€Å"markings† to compare these bands with. However, there were none. The only information that could be extracted from the photographs could be that the proteins in the samples were heavy that they were only located on the upper half of the gel. Conclusion The separation of biomolecules according to charge, size, and shape through electrophoresis could give significant information such as the purity, molecular weight, and, hence, the identity of the biomolecule. In this experiment, the multiple bands produced in the gel set-ups suggested that the samples were heterogeneous. Their location in the gel suggested that the proteins were relatively heavy ones. To gain more valuable information rom these data, it is recommended that a set of standard solutions be also run on the gel so that they could be used as references for the identification of the proteins in the samples. Also, the protein’s exact molecular size could be determined by preparing a calibration curve from a set of standard solutions of proteins, with of course, known concentration. The curve should be a plot of the logarithm of the molecular weight of the protein versus its mobility in the gel matrix. Therefore, Bush became President.   2004 Election: George Bush ran for reelection against Senator John Kerry. The election centered on how each would deal with terrorism and the war in Iraq. In the end, Bush won a little over 50% of the popular vote and 286 out of 538 electoral votes. In the wake of this, Bush announced a new plan for NASA and space exploration including sending people back to the moon by 2018. Captain Corellis Mandolin Essays Captain Corellis Mandolin Paper Captain Corellis Mandolin Paper Essay Topic: Literature The novel Captain Corellis Mandolin, written by Louis De Bernieres in 1994, explores humanity; we sigh at their suffering as they are ripped apart and forever changed by war. 1 The quotation in the title is spoken by Carlo quite early on in the novel, at the end of chapter 15, titled LOmosessuale (4). He is referring to the idea that war is repeatedly shown to be patriotic, heroic, and indeed wonderful especially in film and literature. However, from Carlos experiences in Albania, he knows the true reality of war, as he has seen and experienced the suffering. We can trace Carlos progression of thought through his personal chapters; all entitled LOmosessuale. He begins saying, How wonderful it was to be at this war(p. 119) We hear him describe crossing the foreign border as exhilarating, and he and his comrades view themselves as the new legionaries of the new empire that would last ten thousand years. (p. 119) This was his view at the very beginning of war, before he had really experienced any suffering. As he is yet to encounter any conflict, it is likely he has been influenced by the propaganda at the time, organised by the Italian leader, Mussolini. The next quotation is said slightly further on during Carlos experience, How wonderful it was to be at war, until the weather turned against us. (p. 120) It is here that we begin to hear of some of the suffering that Carlo and his comrades had to endure, such as we were ten thousand men soaked to the bone(p. 120). The real tragedy of war is death, and Carlo has had direct experience of this. He says, War is wonderful until someone is killed(p. 122). This is when De Bernieres chooses to use graphic images to show the suffering that Carlo and his comrades endure. I realised that I was covered with gory scraps of human flesh that were freezing fast to my uniform(p. 122). Finally, Carlo says the quotation in the title, War is a wonderful thing, in movies and in books on page 124. It is here that Carlo has realised the actuality of war, and can see that this idealised version is fictitious and can only be seen in movie and in books. War scorches a trail through all of their lives. What seems, at the beginning of the novel, like a game, a challenge to manhood, a matter of honour, an occasion for political satire, becomes an appalling reality. Carlo asserts that war is shown to be wonderful in movies and in books. However, De Bernieres does not follow this trend, and shows the war for what it is. De Bernieres characters starve and die slowly with their entrails hanging out; he depicts the horror that they have to endure to fight for their country, and the suffering that they are put through. In Albania, Carlo says It was as though a portion of my mind has disappeared, or as though my soul had diminished to a tiny point of grey light(p. 138). De Bernieres also shows the gore and bloodshed caused by the war, when he describes the death of Francesco. In chapter 19, LOmosessuale (6), De Bernieres uses Carlos narrative to tell the reader the true details of Francescos death, and then the sanitised version for his mother. As well as this showing Carlos considerate nature, it also confirms that many people did view the war in a very different light from its reality, including Francescos mother. He died on a fine day, Signora, with the sun shining and the birds singing. (He died on a day when the snow was melting and when, beneath that carapace, there were emerging a thousand corpses, knapsacks, rusted riffles, water bottles, illegible unfinished letters drenched in blood) (p. 148). Corelli wrote the novel, after falling in love with the Island of Cephallonia, and wanting to inform readers about what happened to this Island during World War II. For this reason, he has depicted a very real and veritable account of atrocities that occurred during the Second World War. Everyone is shot, without regard for rank or role, even the medics and the chaplains. However, in the film adaptation of Captain Corellis Mandolin, directed by John Madden, war is viewed in a very different light. De Bernieres has said of the film The problem is that film-makers take out all your good ideas and replace them with a load of stupid ones. 4 The depiction of war in the film is very different and many scenes seem to have been watered down5, in order to appeal to far wider audience. The movie has been widely criticised, after changing the story line drastically from a tragic story of the destruction and consequences of war, to a love story between Corelli and Pelagia. 6 Although much of De Bernieres novel depicts the horror of war, some of the consequences of war are indeed wonderful. Corelli and Pelagia would have never found love without the intervention of war in their lives, and although ultimately war destroys their love, the moments spent together made the war endurable. The prefatory poem at the beginning on the novel shows Louis De Bernieres hinting, even before the novel has begun, that war will be an important theme throughout. The Soldier by Humbert Wolfe describes the waste of war, and the loss of lives and of youth. Links are evident between this poem and Captain Corellis mandolin as they both explore the way in which war has an effect on different people. The presence of war on the Island of Cephallonia has various effects on different characters and can expose peoples flaws and merits. An excellent example of this is the contrast shown between Mandras and Antonio Corelli. Corelli has been drawn into a war that he really has no heart for. You mean youre a soldier by mistake? (p. 206, Pelagia). He has no desires to be a soldier and his character is often seen as anti-military. When giving punishments he does not follow the rules that are expected of him, To everyones surprise the captain pointed his pistol straight into the face of one of the culprits(p. 324). However, although he had no intention of doing so, Corelli proves to be an excellent comrade and shows morality throughout the war. This is my morality, I make myself imagine that it is personal(p. 351). This is greatly contrasted with the character of Mandras. He has very high expectations about the life of a soldier and feels he has to prove himself to Pelagia and the rest of the Island. He resents those who know more than him, yet does not want to prove himself intellectually, as he believes no man is a man until he has been a soldier(p. 80) Carlos assertion that war is wonderful in movies and in books reflects a idealised view of the war. However, Mandras believes that this view was the reality of war and he felt that becoming a soldier would make him more worthy as a man. Ill come back and everyone will say, Thats Mandras, who fought in the war. We owe everything to people like him. He is indoctrinated by what is expected of him, and is predicted to conform. However high Mandras expectations were, the war does not elevate him, it brings him down. During his experiences in war he saw others abuse their power, and now feels he has a right to do the same, The war de-humanises him, and instead of changing him for the better it changes him for the worse. The war in Cephallonia showed the best and the worst in people. In Antonio Corellis case it displays his merits as he has the opportunity to exercise his humanity in the treatment of others. From the beginning of the novel, Corelli is represented as a laid-back, light-hearted leader. Although he has a great talent as a leader, he is very modest and introduces Carlo as one of our heroes, He has a hundred medals for saving life and none for taking it(p. 202). He proves himself as an excellent comrade and Captain by being faithful to his men until the very end. There is no honour in this war, but I have to be with my boys(p. 392). His introduction of La Scala also shows good comradeship, as it is a humorous and practical solution to having to use communal toilets. This is also a crucial element of the novel, as before they go to join the shooting line up, they sing to maintain their composure. He also shows his forgiving nature when he chooses to forgive Gunter for what he has done. I forgive you. If I do not, who will? (p. 397). He says of himself I am not a natural parasite(p. 305) and this is seen clearly when he avoids any confrontation with Pelagia. He is uncomfortable about living with Pelagia and her father Tonight I shall sleep in the yard and tomorrow I shall request alternative accommodation(p. 204). Corellis fondness for animals is De Bernieres way of showing positive traits in a character. The fact that Corelli is so attached to Psipsina shows that he is an admirable man and the reader feel connected to him. The captain had some engaging traits. He tied a cork to a piece of string, and sprinted about the house with Psipsina in hot pursuit and if the animal happened to be sitting on a piece of music, he would go away and fetch another sheet rather than disturb her(p. 250) Corelli also shows fondness for children in his relationship with Lemoni. Although there is a language barrier, the two are able to communicate on a different level, and are able to enjoy each others company. The child was whooping and laughing, and it appeared that what was transpiring was a lesson in Italian. Bella fanciulla, the captain was saying. He was waiting for Lemoni to repeat it. Bla fanshla, she giggled. (p. 211) He also appears to have a very different attitude than other soldiers, when he arrives in Cephallonia with his mandolin strapped to his back, and not a gun, as you would expect from a soldier. The mandolin that was called Antonia because it was the other half of himself. This love for music is another engaging trait that the captain has, and is one of the reasons Pelagia falls in love with him. We also see this originality to his character when Gunter Weber, a german soldier, introduces himself. Weber says Heil Hitler, yet Corelli says Heil Puccini, showing he has a very different attitude to the war, and will not be led by anyone. This again shows his love for classical music, as Puccini was a great composer, whom Corelli was an admirer of. His relationship with Pelagia is clearly one of great love and admiration, however it also contains sexual desires, which are never consummated. Such slender fingers, such pink nails. He imagined them engaged upon amorous and nocturnal things, and realised that he was disturbing Psipsina. (p. 259, Corelli) This shows ongoing respect for Pelagia and her father, and also shows Corellis caring and considerate temperament. In contrast to Corelli, the character Mandras is brutalised by war. He believes that war will change him for the better, yet it changes him for the worse. He becomes a victim of propaganda and a victim of his insecurities. Before he leaves for war he tells Pelagia Im a Greek not a Fascist(p. 14) War changes him for the worse as he is very easily led and allows others to influence him. This may have had a positive effect on Mandras if he had chosen Iannis to guide him, yet he chooses Hector, the leader of a branch of the ELAS. Joining this group causes him to abandon his personal values, and this is seen when he whips the old man. Mandras did not even notice that the man had stopped moving, had stopped screaming and whining(p. 233). He manages to blank out the emotions that he should be feeling, and begins to enjoy the power he holds over this old man. If you didnt think about what it was, it sounded weirdly beautiful(p. 234) After returning from the war, he becomes much more manipulative, especially towards Pelagia and Drosoula. Mandras had begun his exile into inaccessibility by dramatising the idea of death(p. 180). Pelagia was convinced that he was doing it on purpose as an act of vengeance or punishment. (p. 180). This shows a very cruel side to Mandras that we have never seen before, and it clearly takes the war to bring out this negative side of his character. He has clearly been indoctrinated by the propaganda of the war, and this is seen in chapter 63, when he recites communist slogans. The party is never wrong. Whoever is not with us is against us(p. 447) He does not seem to be questioning what he has been told, he just repeats it. He has experienced others abusing their power during his time with the ELAS and now sees this as an approved way of behaving. De Bernii res explores power and its abuse7 He insults and belittles Pelagia after he returns from fighting and tortures her further, even though he should see that she has suffered enough during the war. De Bernieres shows a side to Mandras that readers have never seen before. He represents him as evil and sadistic, and we see Mandras refer to Pelagia as a slut. His morals have disintegrated following his fighting with the ELAS, and feels that he can do whatever he wants. This is due to the fact that the ELAS would make up their own rules for their comrades to follow. The war de-humanises Mandras and he represents the damage that can be inflicted by extreme politics. In Mandras death, De Bernieres wants readers to feel pity for him, as it is clear the communist party has seriously indoctrinated him. He dies as a victim of the war, and a desire to prove himself worthy, and this also evokes compassion in the reader Carlo is a character in the novel who shows how war can bring out the best in people. He is a very honourable character, and has to live with the secret that he is homosexual. He puts aside his desire for Corelli in order to help the romance between Pelagia and Corelli develop. I have loved you with the same surprise and gratitude that I see in your own eyes when you are with Pelagia(p. 384). He shows true bravery in front of the firing squad when stepping in front of Corelli to save his life. Antonio Corelli had found in front of him the titanic bulk of Carlo Guercio(p. 399). De Bernieres uses Carlos narrative in the chapters entitled LOmosessuale, and this allows the readers to sympathise further with the silent suffering that Carlo has to endure during the war. His writings are eloquently written and his language is poetic and beautiful, showing the gentle side to his character. He died on a fine day, Signora, with the sun shining and the birds singing. (P. 148, Carlo) Father Arsenios was saved by the war(p. 292). De Bernieres absolves Arsenios after the war and liberates him from his former self. However, the characters perceive him as a mad man and cannot see that war has brought about his finest hour. He is referred to as the crazy priest yet he feels he is a saviour and it is probable that, had he lived, Arsenios might have become a saint(p. 295). De Bernieres chooses to depict war in a graphic and realistic light in his novel, Captain Corellis Mandolin. Although in many films or books war is shown to be wonderful, this idealised version is proved wrong in De Bernieres novel, as he shows the suffering that the soldiers were forced to endure. He shows that the war has different effects on different people, and it can expose their faults or their merits. Mandras is forever changed by the war, as he returns indoctrinated by the communist party. His death proves that his natural environment is the sea, where he can be accepted and does not have to prove himself. In contrast Corellis merits are shown to be more prominent as the war develops, and also as his love for Pelagia develops. The reader is drawn to the character of Corelli, even though he is an occupying soldier, as he shows compassion, kindness and respect during his time in Cephallonia.

Billy is an over confidante young man whom decides to join the war due to all the advertisement and belief form his father. Unfortunately for Billy, little does he know that this decision will lead him to his cowardly death in the depth of the war. In my group we focused on showing how serious war can be and how you can be extremely hyped up and all of a sudden, that hype is shattered at the sounds of bullets blazing overhead. We used many elements of drama to express and enhance our piece. We started off our piece by having the whole family at the dinner table and the father (Umar) hands out the notice to Billy (me). This automatically kick starts Billys thoughts of becoming a hero and makes himself believe that he is unstoppable. Billys mum (Zeynap) and his younger sister (Marion) are shocked at the thought of Billy going into war especially at a young age of 16. This scene develops many emotions because the family are shocked but also disappointed at the father for filling Billys head with false hope. This starts off the reality of war because people dont think about the casualties war can bring upon us. In Billys eyes it is a chance to become a real man and prove his mother and sister wrong that he can succeed and become a war hero. To show the different emotions flowing through each characters mind, we used thought tracking. We used this technique because we felt it is the best way for a character to express their feelings. Each member of the family expressed how they felt about Billy going to war so it was a good idea because the audience could get some information about the current mood of each character. In the second scene Billy went over to his mate Jamess (Umar) house to try and convince him to join the army as well. This scene shows how Billy is too over confidante at the thought of war and it makes James see that Billy has his head in the clouds. James tries to remind Billy how dangerous war can be but Billy is too consistent on becoming a war hero. After a matter of convincing, Billy eventually manages to get James to agree a chance to become famous and join Billys side on the battlefield. This scene shows how people can be peer-pressured into activities and how your friends word isnt always correct than your gut feeling. In the third scene we have Billy and James signing up for war. This scene was rather interesting because you can clearly see that Billy is really excited but James is rather doubtful at the thought of survival. When he sees how nervous James is he decides to wait and encourage James to sign up. Then as Billy urges James forward, James has a monologue, which explains to the audience that James only wants to help people, not kill them. I think that Umar played this part of the scene very well because he reaches out and really touch the audience with his emotions towards war. In the monologue James shows how he is scared and nervous about going to war and is really re-thinking signing up. Unfortunately for him Billy is too focused on getting them both to war so poor James doesnt really have a chance to tell Billy his feelings. The forth scene was a very intense scene. This scene takes place on the boat, which our brave soldiers are heading off to war. We introduce a new character in this scene. Matthew (Zeynap) is a rather brave and confidante character, mostly a resemblance to Billy. Matthew approaches the free seat next to James but is rudely told to go away by a very frustrated James. Billy lets him sit down and Matthew and Billy begin to talk about how Great War will be. Then suddenly James snaps back to reality and starts to state the obvious about how dangerous war can and will be. Billy tries to calm James down but to no avail. This scene was very affective because the scene was quite to start of with then James starts to shout and it livens up the tempo. As James exits the scene, both Matthew and Billy are left awkwardly deep in their thoughts. In our fifth scene we were situated in a crosscutting dill-lemma. In one scene we had James and Billy back to back in the trenches showing how scared they were and how terrified they both looked. On the other hand we had the mother and little sister back at home thinking about the two boys and how reminding themselves how safe they will be. This scene helped to emprise our true emotions towards war and how war can literally make or break you. The family scene was focused on how positive the war will be and how both family members had full faith In Billy and his courage to succeed. The mother was reassuring the little daughter that Billy will be safe and he will come back a real man. Then we go and look at the two boys in the trenches. You can see that both of them are terrified at the thought of war and will become emotionally depressed. We tried to use the technique of limiting words to try and make the scene more affective because the audience would see my the facial gestures that these two boys are really terrified and may regret the thought of joining the war. Throughout this scene it is clear the audience that everybody is human and even the strongest soldier can even get scared at the sight of men screaming and dieing before their very own eyes. Our sixth scene was the most emotional and exciting scene. In the scene Billy falls to his cowardly death. We tried to make this scene as emotional and touching to the audience because they see the fear in Billy. This scene starts off by Billy asking his fellow soldiers, was it the right decision going to war. James shoots back at him by reminding Billy that this was all his idea and he should face the music. As the cornel (Marion) notifies that its time to shape up and head into the battlefield, every soldier holds their breath, and charges for what could be their last few minutes on this Earth. But then all the focus turns to a whining, shameless Billy Johnson. After all his courage able talk, Billy whimpers in the corner of the trench, unwilling to charge. His cornel shouts at Billy and tells him to get up immediately. Billy refuses and back talks. This shocking coward ness form a soldier leads to Billys cowardly death. This scene proves to the audience that even the most cockily people can be overpowered by fear. It made me really feel for Billy as I played this scene because his father encouraged him that war will make him a hero. It made me realise that Billy was just a young boy trying to impress his family and make a small difference in this world. As Billys life ends, the next scene shows the after shock of this disgusting news. Our final scene shows how the thought of never hearing a family members voice, touching their skin or even smelly their scent can make you wish death upon you. This scene was very emotional because you can see how upset and distraught the familys reactions were towards Billys death. These sorts of moments will always be remembered as emotional crashes in out lives. It makes us realise that you got to hold onto and be grateful for what you have because you dont know what you have until its gone. In this project I have learnt a lot about the affects of war, the ups and downs and most importantly the way the human mind functions. This play made me realise that not everything is as exciting or rewarding as its said to be and we should think fully through our decisions before we make them.
